David is an Associate practicing in the areas of creditors' rights, insolvency and bankruptcy, workouts and troubled debt restructuring, and litigation.  He has successfully represented the diverse interests of lenders in both pre- and post-judgment stages of commercial debt proceedings against borrowers, guarantors, and competing creditors, including the following:

  • Loan and security document review and analysis.
  • Single and multi-faceted forbearance agreements.
  • Exercise of remedies under assignments of leases and rents.
  • Appointment of receivers, injunctive and other equitable remedies.
  • Foreclosures by advertisement and judicial foreclosures of commercial, industrial, and residential properties.
  • Article 9 dispositions of collateral.
  • Commercial debt recovery and lender liability litigation.
  • Debtor fraud, conversion, collateral dissipation, and fraudulent transfer litigation.
  • Creditor’s examinations and other post-judgment enforcement.

David also brings years of experience to bear in bankruptcy matters, with a special focus in personal bankruptcies, including the representation of lenders and other creditors in the following:

  • Review and analysis of bankruptcy schedules and statements.
  • Preparation and filing of proofs of claim.
  • Attendance at meetings of creditors and taking Rule 2004 examinations.
  • Proceedings for relief from the automatic stay and to object to reorganization plans.
  • Adversary litigation against Debtors to determine dischargeability or object to discharge.
  • Defense of preference and fraudulent transfer adversaries.
