Seyburn Kahn Obtains Dismissal of Breach of Contract And Wrongful Termination Claims

A Seyburn client that sells health and weight-loss products direct to consumers, prevailed in a lawsuit brought by one of its former independent representatives.  Seyburn successfully argued on behalf of its client that the terms and conditions in the independent representative’s agreement and  Policies and Procedures permitted the company to terminate an independent distributor for unethical conduct as determined in the best judgment of the company.

“We had moved to dismiss these claims as a matter of law months ago,” said Barry M. Rosenbaum, counsel for the company.  “The trial judge had taken the matter under advisement and issued an opinion only a week before we were scheduled to go to trial.”

All of the company’s  independent representatives operate under the same Agreement and Policies and Procedures and the company was pleased that the court affirmed its authority to monitor the conduct of its promoters.  The case was litigated in the Oakland County Circuit Court.
